FOREIGNERS AND SALE OF PROPERTY IN THE REPUBLIC OF CROATIA

In the Republic of Croatia, foreign citizens can acquire real estate under special conditions prescribed by the Law on Property and Other Real Rights. In relation to the conditions for the acquisition of property rights set by the law in question, those set for the acquisition of real estate by foreigners who are not citizens of the EU member states differ from those set for the acquisition of real estate by foreigners who are citizens of the EU member states.

 

Foreigners who are not citizens of the member states of the European Union

Foreign natural and legal persons may, under the assumption of reciprocity, acquire ownership of real estate in the territory of the Republic of Croatia, if consent is given by the minister responsible for judicial affairs of the Republic of Croatia. The granting of such consent is decided at the request of a foreign person who intends to acquire ownership of a certain real estate or a person who intends to alienate it. As a rule, giving this kind of consent, if there are no exceptional circumstances, does not pose a problem and can be considered a formality.

It is noted that a foreign person cannot acquire ownership of real estate located in an area that, in order to protect the interests and security of the Republic of Croatia, has been declared by law to be an area where foreign persons cannot have the right of ownership, unless otherwise stipulated by law.

 

Foreigners who are citizens of the member states of the European Union

Citizens and legal entities based in the member states of the European Union acquire the right to own real estate under the same assumptions as for the acquisition of ownership rights for citizens of the Republic of Croatia and legal entities based in the Republic of Croatia. An exception to the acquisition of ownership rights to real estate in the Republic of Croatia under the assumptions that apply to Croatian citizens are real estate in exempted areas, that is, agricultural land determined by a special law and protected parts of nature according to a special law.
